NEW YORK (CBSNewYork/AP) — Nearly four years after Eric Garner died during an arrest on Staten Island, the NYPD gave the U.S. Justice Department an ultimatum; if federal investigators don’t take action on the case by the end of August police brass will step in. Garner died four years ago Tuesday, and the department says it’s ready to start hearings against the officers involved and cannot wait any longer for the federal investigation to wrap up. Cell phone video from July 17th, 2014 captured officers trying to arrest the 43-year-old Garner for allegedly selling loose cigarettes. Officer Daniel Pantaleo is seen putting his arm around Garner’s neck as he pulled him onto the ground. Garner was repeatedly heard saying “I can’t breath,” and later died. In a letter to the Justice Department, NYPD attorney Lawrence Byrne says the department didn’t move ahead with disciplinary proceedings because it did not want to impact the federal investigation into the case. Now, the NYPD is giving the DOJ until August 31st to announce whether it will file civil rights charges. If no decision is announced, Byrne says the department will move forward. Garner’s family spoke just a short time ago. “We want it to be done swiftly,” mother Gwen Carr said. “We don’t want politics to play a part in this. We just want justice for my son.” PBA President Patrick Lynch released a statement Monday saying he agrees the DOJ should move to close Officer Pantaleo’s case, and they’re confident he will be vindicated. A Staten Island grand jury did not indict the officer on charges in Garner’s death. Pantaleo remains on modified duty.

NEW YORK (CBSNewYork) — The NYPD released video of two men wanted for shooting two people in Brooklyn. Surveillance footage shows a man in a white t-shirt pacing near the Brownsville Houses on Stone Avenue on July 3rd. The man then hands what appears to be a gun to another man in a black sweatshirt. Police say that man fired several shots at a group inside a park at the housing complex. A man and woman, both 19, were shot in the leg and rushed to the hospital with non-life threatening injuries. NYPD Releases Surveillance Video Of Suspects In Brooklyn Shooting
NEW YORK (CBSNewYork) – A plaque honoring the late NYPD Detective Steven McDonald was dedicated Thursday at his old precinct in Central Park . Police Commissioner James O’Neill and Mayor Bill de Blasio presided over Thursday’s ceremony, which took place 32 years to the day after McDonald was shot three times by a 15-year-old boy while investigating a bicycle robbery in the park. More: Remembering The Legacy Of NYPD Detective Steven McDonald McDonald survived, but the shooting left him paralyzed from the neck down and needing a ventilator to breathe. Eight months later, McDonald forgave the teen and then traveled the world, inspiring others with speeches on faith and forgiveness. McDonald died on January 10, 2017, at age 59 after suffering a heart attack. McDonald’s wife and son say they hope the plague serves as a reminder of his legacy. “If a man who was shot by a 15-year-old kid when he did nothing, but just try to talk to him – can live a life of love and compassion, I think we all can do that and we all can sit down and talk to each other,” said McDonald’s son, Conor, who followed in his father’s footsteps and is now a sergeant in the NYPD.

NEW YORK (CBSNewYork) — Police have released new surveillance images of the suspect they are searching for in the attempted rape of a woman jogging inside a Bronx park. It happened around 7:50 a.m. Monday inside Bronx River Forest Park near 204th Street and Webster Avenue. Police said the suspect followed the 35-year-old victim, came up behind her and placed his hand over her mouth and arm across her chest, trying to pull her backwards. She fought him off and managed to get away, but police say the suspect approached her a second time. That’s when she was able to snap a picture of him on her cell phone. Police say a woman who managed to escape a would-be rapist snapped a cell phone picture of her attacker. (credit: NYPD) The suspect was described as a Hispanic man, 17 to 25 years old with a slim build. He was last seen wearing a white hooded sweatshirt with a black shirt across his chest, black shorts and white sneakers. The victim was treated for minor injuries. The NYPD insists crime is down overall , but rapes are up 34 percent: 912 from the first six months of 2018 compared to 680 in 2017. Police are offering a $2,500 reward for information leading to an arrest. NEW YORK (CBSNewYork) — Police are looking for a suspect who they say is wanted for a violent purse snatching in Brooklyn. It happened around 3:30 a.m. on July 4 in the area of Cook Street and Graham Avenue in Williamsburg. Police said the suspect followed a 30-year-old woman to her building’s front door. As she walked in, police said he grabbed the purse from her shoulder and pulled her off the stoop. She fell, hitting her face on a parked car. The suspect took off with about $200 in cash, the woman’s cell phone and credit cards. She was treated at the hospital for pain and bruising. WASHINGTON (CBSNewYork/AP) — Mayor Bill de Blasio and his security detail violated both Mexican and U.S. immigration laws by crossing the border on foot during a visit near El Paso, Texas, U.S. Customs and Border Protection alleges in a letter obtained by The Associated Press. The mayor’s office flatly denied the allegation. De Blasio, a fierce critic of the Trump administration’s immigration policies , went to the Texas border with about 20 other mayors from around the country on June 21, the day after President Donald Trump signed an order stopping family separations at the border. “Every country needs reasonable law enforcement on their borders. ICE is not reasonable law enforcement. ICE is broken, it’s divisive and it should be abolished,” the mayor tweeted last month . More than 2,300 families were separated as a result of the administration’s zero-tolerance policy, which criminally prosecutes anyone caught crossing illegally. The mayors said Trump had failed to address a humanitarian crisis of his own making. According to the letter, a uniformed Border Patrol agent noticed a group on the Rio Grande River flood plain south of the Tornillo, Texas, Port of Entry, taking photos of the holding facility. The agent asked if anyone from Border Patrol or public affairs was there to authorize their presence. A New York Police Department inspector said no, according to the letter, and when the agent asked the group how they arrived, they pointed to Mexico. The agent told them they’d crossed the border illegally and asked them to remain there while he got a supervisor and took them to an official crossing for an inspection per federal law, according to the letter. But the group disregarded the order and drove back to Mexico, according to the letter. However, de Blasio said Wednesday the border agents let him cross and called the charges “absolutely ridiculous.” “We were told where the border line was, and we respected it. We came back the exact same way, both times showed passports,” he said. “At no point did we disregard any instructions from federal authorities, period.” De Blasio spokesman Eric Phillips said the group did nothing illegal and had approval to be there. “The mayor crossed the border with the direct approval and under the supervision of the border patrol supervisor at this port of entry,” Phillips said in an email Tuesday night to the AP. “Any suggestion otherwise is a flat-out lie and an obvious attempt by someone to attack the Mayor because of his advocacy for families being ripped apart at the border by the Trump Administration.” Phillips had posted tweets of the mayor’s visit on June 21. Gomez also raised another issue about the mayor putting his security detail in a tough spot. “It’s not to the NYPD to determine which is the border. The NYPD’s jurisdiction is obviously within the confines of the five boroughs of the city of New York,” he said. “It shouldn’t be up to them to discern and educate the mayor of New York as to where the border between the U.S. and Mexico is.” A spokesperson for the Border Protection had no comment. The letter was sent June 25 by Aaron Hull, the chief patrol agent for the Border Patrol’s El Paso Sector to New York Police Department Commissioner James O’Neill . The mayor blamed the letter on politics and his disagreements with the Trump administration. An NYPD spokesperson told Kramer that O’Neill reviewed the letter and will not take action against any of the NYPD officers involved.

Feds Say Mayor De Blasio Crossed U.S.-Mexico Border Illegally
NEW YORK (CBSNewYork) — New Yorkers were on edge Monday after a string of random crimes throughout the city. One of the most violent was an attack on the subway in Lower Manhattan, where a man was caught on camera viciously beating another passenger with a metal object. The 59-year-old victim’s skull was fractured and the suspect has since been arrested, but the NYPD maintains there’s no crime wave. In fact, the department insists crime is actually down. “These are a couple of individual acts of violence that happened,” NYPD Chief of Department Terrence Monahan said in an exclusive interview with CBS2 political reporter Marcia Kramer. “If you look at each of the three instances we were able to respond quickly and make arrests.” NYU junior Cat Heinen says being violently ambushed and beaten by a homeless man in the East Village late Saturday has left her scared and shaken. “I don’t think I can walk alone for a long time,” she told CBS2. “I’ve been walking with my keys in hand.” Heinen also says she’s bought pepper spray after the terrifying ordeal. While the NYPD was quick to catch the man who attacked Cat and two other women, she says the experience has changed her life. “This has been really traumatic and awful,” she said. “He got me right to the ground and kept punching, I’m pretty sure he was going to rape me.” She’s just the latest victim in a recent string of random crimes. In addition to the East Village assault and Lower Manhattan subway attack, police say a man tried to rape a woman getting out of an Uber on the Upper West Side last week. The NYPD insists that there’s no crime wave. Statistics for the first six months of the year show overall crime is down another 1.8 percent, from 46,190 to 45,337. While overall stats continue to be low, one problem area is rapes. Statistics show rapes are up 34 percent; 912 from the first six months of 2018 compared to 680 in 2017. In terms of the random crimes seen recently, what is the city doing to assure people they’re safe? “Listen, this is a city of 8.6 million people, there are going to be incidents that happen,” Monahan said. “The NYPD is the best at keeping people safe and we’re out there. If there are some individualized acts of violent crime that take place, rest assured we’re going to go after the small amount of individuals that perpetuate them.” In this era of social media, Monahan urges New Yorkers who see crimes to take pictures and share them with cops to help solve crimes like the subway attack quicker. The NYPD will have extra officers on the streets this summer. 300 will be part of “Operation All Out,” and 750 just graduated from the police academy.

NEW YORK (CBSNewYork) — An NYPD detective has been released from the hospital after he was shot in the leg Friday in Brooklyn. The shooting happened around 6:40 a.m. on Decatur Street in the Bedford-Stuyvesant neighborhood. Police Commissioner James O’Neill On Officer Shooting Police said Det. Miguel Soto and his partner were in an unmarked police van when they noticed 33-year-old Kelvin Stichel, who was wanted in a domestic armed robbery. “The police identified themselves and told the man to show them his hands,” said Police Commissioner James O’Neill. “The suspect then displayed a gun and shot at the officers, striking a detective once in the leg. The detective returned fire as the two other officers and the suspect ran away.” A NYPD detective who was shot in Bed-Stuy on July 6, 2018, was released from the hospital the same day. (credit: CBS2) Soto was shot once in the right thigh, and the bullet passed through his leg. “He’s a real tough guy. I’m glad he’s part of the NYPD. He does a great job each and every day,” O’Neill said. The 32-year-old husband, father and seven-year member of the NYPD was treated at Kings County Hospital and released about eight hours later. Stichel was shot in the arm. He was taken to Brookdale University Hospital Medical Center where he was expected to survive. Police said the officers followed a trail of blood to find him hiding in the hallway of an apartment building on Kingston Avenue.
