FLORIDA (CBSDFW.COM/CBS Local) – A woman from Dallas, Texas will spend 15 days in jail as punishment for taking 40 queen conchs from the waters that surround Key West. While it’s not illegal to take queen conch shells from the waters or lands in Florida, it is illegal if the removed shells contain a live animal at the time. Additionally, the mollusk must not be mutilated, removed from its protective shell, or killed before taking the shell. Diana Fiscal-Gonzalez told the Miami Herald that she planned to clean the conchs and give the shells away as gifts. The 30-year-old pleaded no contest July 13 at the Monroe County Courthouse to taking the conchs. She apologized to Judge Mark Wilson, saying she didn’t know it was illegal to take the state-protected mollusks. She had plucked the conchs from the sea with the help of several children. Fiscal-Gonzalez received credit for one day of time served. Wilson cut her a break by withholding adjudication, which means she won’t have a criminal conviction on her record, according to the Miami Herald. Fiscal-Gonzalez will also serve six months of probation and pay a $500 fine plus $268 for court costs. An officer from the Florida Fish and Wildlife Conservation Commission arrested Fiscal-Gonzalez on July 13, 2017, at 1216 Watson St. in Key West after an anonymous tipster called the agency about it. FWC Officer John Martino said when he got to the house he saw a woman in plain view with three plastic containers and a water hose in the driveway. The conchs were in the containers. After photographing the conchs, Martino returned them to the water. Most were still alive, FWC said. The conch is a beloved symbol in Key West, with natives of the island calling themselves “conchs,” and the local high school has the mollusk as a mascot. Fiscal-Gonzalez must report to court on Aug. 10 to begin her jail sentence.

POMONA (CBSLA) – A worker died after getting pinned under a forklift on a construction site in Pomona Friday morning. (CBS2) The incident was reported before 10 a.m., off the eastbound 10 Freeway and Kellogg Drive, near Cal Poly Pomona, according to the Los Angeles County Fire Department. Firefighters responded to reports of a worker trapped underneath a forklift. He died at the scene, the fire department reported. His name was not released. The circumstances leading up to the accident were not confirmed. UPDATE: #VerdeIC #Pomona deceased has been removed from under the forklift. NEW YORK (CBSNewYork) — Authorities seized more than 55 pounds (approximately 25 kilograms) of suspected heroin and fentanyl late Wednesday night from a Bronx apartment that allegedly served as a drug packaging mill, law enforcement officials said. The drugs, worth an estimated $7.5 million, were taken from a two-bedroom apartment on Morrison Avenue in the Soundview neighborhood of the Bronx. Agents recovered 11 kilograms of suspected heroin was found in one bedroom closet, another 10 kilograms hidden in a wall and approximately 230 grams of heroin in a dresser. In the other bedroom, agents found a variety of equipment used to process the narcotics for street-level distribution, including 100 different ink stamps for branding individual dose envelopes, according to the city’s Special Narcotics Prosecutor’s office. Names on the stamps included, “Kill,” “Death,” “100%,” “UPS,” “Heartless” and “Super High.” Prior to the search, agents and investigators were conducting surveillance in the area when they observed Luis Guzman-Rojas, 46, enter the apartment building at around 8:20 p.m. Wednesday and leave shortly after with a black plastic shopping bag. They followed the livery car that drove Guzman-Rojas away and stopped it at the corner of Bruckner Boulevard and Hunts Point Avenue. Guzman-Rojas was arrested after agents and investigators observed him in the back seat with plastic-wrapped kilogram of suspected heroin marked with the letters “LV” and the same shopping bag he carried from the apartment building, the prosecutor’s office said. The Special Narcotics Prosecutor’s Office got a search warrant for the apartment and went in at approximately 11:05 p.m., officials said. Four men found in the apartment’s living room area — Matias Rosario-Ramon, 37, Anthony Polanco, 29, Willy De La Cruz, 28, and Pedro Sandoval, 26 — face charges of criminal possession of a controlled substance and criminally using drug paraphernalia. Guzman-Rojas is charged with criminal possession of a controlled substance, officials said. The Special Narcotics Prosecutor’s Office conducted the raid with the New York Drug Enforcement Task Force, which includes agents and officers with the federal Drug Enforcement Administration, NYPD and the New York State Police.
