NEW YORK (CBSNewYork) — An MTA worker is recovering from a gunshot wound after being hit by a stray bullet in the subway in Brooklyn. The scene unfolded around 6 p.m. Tuesday on a crowded 3 train at the Sutter Avenue station in Brownsville. Witnesses said it began when two groups of men in their 20s stated fighting on the subway. As the train pulled into the station, investigators say one of the men got off and pulled out a weapon. “I just heard a loud shot,” said witness Kiosha Kirkland. “Then I see everyone running.” “While on the train platform, displayed a gun and fired into the train striking our victim,” said Brooklyn North Chief Michael Kemper. The victim, believed to be an unintended target, was an off-duty MTA worker who had just finished his shift and was heading home. He was struck in the arm. The gunfire sent scared straphangers scrambling, CBS2’s Janelle Burrell reported. “Just everyone else from the train running, trying to cover for safety,” said Kirkland. NYPD Transit Chief Edward Delatorre says the subway averages about six million riders and about six crimes per day. “In reality, the system is very safe,” he said. “Safer than it’s ever been.” But after a rash of subway attacks in the last couple of weeks alone, CBS2 asked the transit chief how he could reassure concerned riders. “Those incidents are few and far between,” he said. “When you have six million riders a day riding in the system, you’re gonna have random incidents as well.” New York City Transit President Andy Byford said he was “appalled” by the shooting. He and MTA Chairman Joe Lhota visited the employee in the hospital Tuesday night and said he is in good spirits. Lhota added that transit workers “are on the front lines” every day and said “this shouldn’t happen to anyone.”

WASHINGTON (CBSLA) — President Trump on Monday selected 53-year-old Brett Kavanaugh to replace Anthony Kennedy on the Supreme Court. The president made the announcement in the East Room of the White House. Protests were held around the nation as liberals, democrats and progressives fear the president’s right-leaning pick will give conservatives a majority for decades to come. Why did Kavanaugh get the nod? He has extensive experience working in D.C. courts and its political scene, officials said. He once served as a clerk under Justice Kennedy. Last year, Trump picked Neil Gorsuch to replace the late Antonin Scalia. Kavanaugh shook Trump’s hand and then took to the podium. He said, “Mr. President, thank you. Throughout this process, I’ve witnessed first hand your appreciation for the vital role of the American judiciary. No president has ever consulted more or widely or talked to more people from more backgrounds to seek input about a Supreme Court nomination.” Establishment republicans lauded the selection. Senate Majority Leader Mitch McConnell, who blocked President Obama from seating Merrick Garland, called the Kavanaugh pick “a superb” choice. Democrats were quick to express their displeasure and outrage. GLAAD, the world’s largest LGBTQ media advocacy organization, condemned the choice. “Kavanaugh’s extreme conservative record and his past support by anti-LGBTQ hate group Family Resource Council (FRC) are deeply concerning. Kavanaugh could carry out the expressed views of President Trump, who as a candidate stated that he disagreed with the Supreme Court’s gay marriage ruling in the case of Obergefell v. Hodges and said he would ‘strongly consider’ appointing judges who would overturn the decision,” GLAAD said. Cong. Adam Schiff pointed out the president picked someone who doesn’t believe the president should be subject to criminal investigations. Ever mindful of his self-interest, Trump has picked Brett Kavanaugh, who once wrote that he didn’t believe a sitting President should be subject to criminal investigation or prosecution. Specifically, as a replacement for Justice Anthony Kennedy, his nomination presents an existential threat to the health care of hundreds of millions of Americans.” She added, “Judge Kavanaugh has consistently proven to be a conservative ideologue instead of a mainstream jurist. As recently as last year, he disregarded Supreme Court precedent and opposed the health care rights of a vulnerable young woman. That ruling was overturned by a sitting of all the judges on his court. In 2015, Kavanaugh wrote that an employer, based on their personal beliefs, can deny their employee access to birth control coverage.” Sen. PASADENA (CBSLA) — A City of Pasadena employee has come under fire after video emerged of him telling a woman with a child in her car that she needed to learn how to drive. In the video, the unidentified man is heard saying, “You need to learn how to drive,” as he walks near his city-issued vehicle. The white Ford Focus with “Building & Safety” on it appears to block the woman’s car. The woman who recorded the incident wished to remain anonymous. She is heard confronting the man while he is on his mobile phone. “Bro, chill out,” she says. “Why don’t you chill out? I just almost rammed into her car, and all the stuff on the inside of my car is damaged,” he replies. The target of his harassment then tries to explain herself. “I’m not from here,” the woman says. “I don’t care where you’re from. Wherever you live, you gotta know how to drive. You’re driving a vehicle, aren’t you?” he asks. “I didn’t know you had to be so rude and mean,” the woman says. The bystander steps in, saying, “Yo, you can’t block her.” “I can do whatever I want,” the man says. “Um, you cannot. Just because you have a Building and Safety, […] You’re not the f—–g cops,” the witness chuckles. The man refuses to move his vehicle for several minutes before two security officers arrive, at which point he drives on, but not before confronting them, as well. “Who are you?” the man asks. “We’re private security. You’re parked on private property,” one of the officers says. “I work for the city and I have a…” the man says before getting interrupted. “Cool, I’m calling the city, too,” the bystander interjects. Unconvinced, the man continues, “So, you’re telling me that I can’t come in here and do my job?” “Yeah, you could do it, but we are telling you that you’ve got to leave her alone,” the guard says. “At the end of it, once he finally left, like, both she and her daughter teared up,” the woman who recorded the incident told CBS2 News. She said she wants the City of Pasadena to take action. “She aplogized. It’s like he wouldn’t stop being patronizing,” she said. A City of Pasadena spokesperson confirmed the man is their employee. However, they would not say what type of disciplinary action, if any, the man would face, as this is a personnel matter. The man is still employed with the city.
