NEW YORK (CBSNewYork/AP) — A federal judge wants to know if the U.S. government has “any concept of justice” in mind for an Ecuadorean immigrant detained while delivering pizza to a Brooklyn Army installation. Judge Paul Crotty questioned the government’s handling of the case as he heard legal arguments Tuesday over what court should help decide the fate of Pablo Villavicencio. He did not immediately rule whether the legal case to free Villavicencio should be heard in New Jersey or New York. Family and supporters of Villavicencio rallied at City Hall Monday. On June 1, he was arrested while delivering pizza to Fort Hamilton Army Base in Brooklyn. An ID check revealed he had an outstanding deportation warrant. The father of two has an open Green Card application. Another judge already temporarily blocked his deportation. He has remained in ICE custody in New Jersey. (© Copyright 2018 CBS Broadcasting Inc. PLAISTOW, N.H. (CBS Local) – A Massachusetts man apparently learned the hard way that the “Judgment Free Zone” philosophy at Planet Fitness only goes so far. Police say 34-year-old Eric Stagno was walking around naked at the Plaistow gym before settling in on the yoga mats . Officers arrived at the Planet Fitness to find him nude on his knees in a yoga-type position. The Haverhill man was arrested without incident and charged with indecent exposure/lewdness and disorderly conduct. Eric Stagno (Photo credit: Plaistow police) “The only statement that he made was that he thought it was a ‘judgment free zone’ – apparently referencing the chain’s slogan,” police Capt. Brett Morgan told WBZ-TV. Gymgoers who saw Stagno’s naked exercises reported feeling “disgusted,” “sick” and “unsafe,” Morgan said. Stagno was released on $1,000 bail and is due on Plaistow Circuit Court on Sept. 21. [H/T CBS Boston ]

NEW YORK (CBSNewYork) — A brand new 3D security scanner is going into service Tuesday at JFK Airport. The machine uses CT technology like a hospital CAT scan. It gives TSA agents the ability to differentiate items inside a cluttered bag and also to rotate images in any direction. JFK has one of just eight machines nationwide that’s ready for use. It will be in the American Airlines terminal.

LOS ANGELES (CBSLA) — With triple-digit temperatures forecast across much of Southern California Tuesday, the state has issued a Flex Alert to urge electricity conservation for high-usage hours. The hottest days of the heat wave are expected to be Tuesday and Wednesday, raising concerns for power outages, heat-related illnesses, and wildfire danger. “Consumers are urged to conserve electricity especially during the late afternoon and evening, when air conditioners typically are at peak use,” a California ISO statement said. “Consumers can help avoid power interruptions by turning off all unnecessary lights, using major appliances before 5 p.m. and after 9 p.m., and setting air conditioners to 78 degrees or higher.” High temperatures across the western U.S. prompted the Flex Alert. The excessive heat warning will be in force along the L.A. County coast, in beach cities, metropolitan Los Angeles, Downtown L.A., and the Hollywood Hills; the San Gabriel, San Fernando, Santa Clarita and Antelope valleys; the San Gabriel and Santa Monica mountains; and inland Orange County, where highs will range from the mid-90s to 104. It will expire at 8 p.m. Thursday. Also in effect was a less serious heat advisory scheduled to expire in Orange County at 9 p.m. Thursday. There won’t be much relief from the heat along the coasts, but people seeking to cool down in the ocean should beware of bigger waves and strong rip currents. A high surf advisory will be in force in L.A. and Orange counties until 9 p.m. Wednesday and surf of 4-7 feet is expected through Wednesday night in L.A and Ventura counties, with maximum sets to 9 feet. In Orange County, surf of 5-8 feet is expected. (© Copyright 2018 CBS Broadcasting Inc. All Rights Reserved. City News Service contributed to this report.)
